Two Memphis men indicted in 2006 voter fraud

Dale Brown, 50, and Kelvin Green, 41, were indicted on one count each of illegal registration or illegal voting. The offense carries a penalty of two to 12 years in prison and a $5,000 fine.

The indictment says Brown voted in the state primary and the county general election in August 2005, although he was not eligible to vote because of a felony aggravated assault conviction in 1985.

Green voted in the primary and general elections despite being convicted in 1997 of driving while a habitual motor vehicle offender, also a felony.

There was no explanation why they were being indicted fours years later.

The two men were arrested Thursday evening. Brown is being held on $1,000 bond. Green was released on his own recognizance.

Dist. Atty. Gen. Bill Gibbons said the indictments do not allege that the men were involved with any specific candidate or campaign.

He said the indictments stem from information the Shelby County Election Commission provided to the Tennessee Bureau of Investigation. Gibbons said more indictments are possible.

Shelby County voters can report problems at the polls by calling the election commission at 545-4125.
